Abstract

The advancement of digital technology has transformed banking services through mobile banking, offering convenience and efficiency for customers. However, this progress also presents significant challenges regarding legal protection and data security. This study aims to analyze the effectiveness of banking regulations in providing legal safeguards for mobile banking users and to examine the bank’s responsibility for risks or losses experienced by customers. Using a normative juridical approach, the research explores the gap between das Sein (empirical reality) and das Sollen (ideal legal norms) in the practice of legal protection. The findings indicate that although regulations such as the Banking Law, Consumer Protection Law, and Electronic Information and Transactions Law provide principles of prudence and bank accountability, their implementation still faces technical constraints and system vulnerabilities. Therefore, regulatory reinforcement and dispute resolution mechanisms must be enhanced to better adapt to technological developments and cyber threats.
